Welcome to Nobotiq ("Company", "we", "our", "us"). These Terms of Use ("Terms") govern access to and use of the Nobotiq website, dashboard, API, integrations, and any module, plugin, script, or other software component that a customer installs on its own website or application to send data to Nobotiq for analysis (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

1. Introduction

Nobotiq provides spam, bot, abuse, and risk detection tools that may be used through our dashboard, API, or customer-side modules and integrations. The Service is intended for website owners, businesses, developers, and other authorized users who want to analyze submissions, messages, emails, form activity, and related technical signals.

The Service may use proprietary models, internal rules, and third-party data sources or anti-abuse providers in selected cases. Nobotiq does not state or guarantee that every request is processed by any specific third-party provider.

Users must be at least 18 years old to register for or use the Service.

2. Account Registration

1. To use paid or authenticated features of Nobotiq, you must create an account and provide accurate, current, and complete information.
2. New users may receive a free trial with 3,000 credits without providing a payment card, unless otherwise stated on the platform.
3. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. You must promptly notify us of any unauthorized access to or use of your account.

3. License, Credits, and Payments

1. Subject to these Terms and any applicable plan, Nobotiq grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service during the active subscription or credit period.
2. Spam checks, lookups, and related Service operations may consume credits based on the type of content, feature, or request volume.
3. Additional credits or subscriptions may be purchased through Stripe or other payment methods made available on the platform. Payments are converted into credits or service access according to the selected plan.
4. Unless expressly stated otherwise, credits are non-refundable, non-transferable, and have no cash value. Promotional discounts or benefits may be available under separate campaign rules published on the platform.
5. You authorize Nobotiq and its payment processors to charge the payment method you provide for purchases, renewals, upgrades, and usage-based charges that you approve through the Service.

4. Use of the Service

1. The Service may be used to analyze text, messages, comments, forms, reviews, email addresses, IP addresses, device or browser signals, and other submitted data for spam, bots, phishing, abuse, fraud, or malicious activity.
2. If you install a Nobotiq module, plugin, script, or integration on your own website or application, that component acts only as a technical means to transmit data from your environment to Nobotiq for analysis through the API or related Service infrastructure.
3. In some cases, Nobotiq may submit limited data or indicators, such as email addresses, IP addresses, message fragments, hashes, reputation signals, or technical metadata, to external anti-spam, anti-abuse, reputation, or verification providers when reasonably necessary to provide, secure, or improve the Service.
4. You agree to use the Service only for lawful purposes and only in relation to data that you are authorized to submit for analysis.

5. Customer Data and Responsibilities

1. You are responsible for all data, content, and materials that you or your end users submit, transmit, or make available to Nobotiq through the Service.
2. You represent and warrant that you have all rights, permissions, and lawful bases required to collect and submit such data to Nobotiq, including providing any required privacy notices and obtaining any necessary consents from your website visitors, users, or customers.
3. You grant Nobotiq the right to host, copy, transmit, analyze, transform, and otherwise process submitted data solely as necessary to provide, maintain, support, secure, and improve the Service and to comply with legal obligations.
4. You remain responsible for determining whether your notices, consents, retention settings, and configuration choices are sufficient under the laws applicable to your business and users.

6. Prohibited Activities

You may not:

• Use the Service for illegal, deceptive, abusive, or harmful purposes, including activities that harm minors or violate applicable privacy, marketing, or cybersecurity laws.
• Submit data that you are not authorized to process or disclose.
• Reverse engineer, copy, resell, sublicense, redistribute, or create derivative works of the Service except as expressly permitted by law or by written agreement with Nobotiq.
• Introduce malware, exploit vulnerabilities, overload the Service, or interfere with its operation or security.
• Attempt unauthorized access to servers, accounts, systems, data, or third-party services connected with Nobotiq.

7. Intellectual Property

1. Nobotiq and its licensors own all rights, title, and interest in and to the Service, including the platform, API, software, models, interfaces, documentation, trademarks, and related content, excluding customer data.
2. Except for the limited license expressly granted under these Terms, no rights are granted to you by implication, estoppel, or otherwise.

8. Purchases and Billing

1. All payments are processed securely by third-party payment providers such as Stripe.
2. You agree to provide accurate billing information and to keep that information current.
3. Nobotiq may suspend paid features or access if charges are declined, reversed, unpaid, or reasonably suspected to be fraudulent.

9. Suspension and Termination

Nobotiq may suspend, restrict, or terminate access to the Service at any time if you violate these Terms, use the Service unlawfully, create security or operational risk, or fail to pay applicable fees. Upon termination, your right to use the Service ends immediately, and any unused credits may be forfeited unless otherwise required by law or stated in a separate written agreement.

10. Limitation of Liability

The Service is provided "as is" and "as available". Nobotiq does not guarantee uninterrupted availability or 100% accuracy of spam, abuse, or fraud detection results.

To the maximum extent permitted by applicable law, Nobotiq, its affiliates, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities arising out of or relating to the Service.

Nobotiq's total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount actually paid by you to Nobotiq for the Service during the twelve (12) months preceding the event giving rise to the claim.

11. Disclaimer and Maintenance

Use of the Service is at your own risk. Nobotiq may perform maintenance, updates, repairs, or emergency changes that temporarily affect availability, integrations, or functionality. We may modify underlying detection logic, workflows, or supporting providers without prior notice where this does not materially reduce the core functionality of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Nobotiq, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your data, your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

13. Changes to the Service or Terms

Nobotiq may modify, restrict, or discontinue all or part of the Service at any time. We may also update these Terms from time to time. Updated Terms become effective when posted on this page unless a later effective date is stated. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Third-Party Services

The Service may integrate with or rely on third-party hosting, analytics, payment, communication, verification, anti-abuse, reputation, and security providers. Nobotiq is not responsible for third-party services themselves, but may use them as subprocessors, suppliers, or infrastructure providers in order to operate the Service.
